Delaware River Basin Commission
West Trenton, New Jersey

I respectfully demand protection of my Rights declared by the Constitution of the Pennsylvania Commonwealth.*
I demand the defense of our U.S. Constitution through which my Rights are secured.

The Delaware River Basin Commission (DRBC) as regulatory authority over the Delaware River Watershed in four States may vote to lift the current moratorium on fracking in the Delaware River Watershed.

To allow fracking to proceed as planned by the Fracking Industry jeopardizes at least 3 of the 6 purposes for which our U.S. Constitution is established:

Purpose #1, Establish Justice--
The limited opportunities for we-the-people impacted by fracking to hear full-disclosure, and be ourselves fully heard, and the hardship of traveling to distant meetings with "decision makers," violate a basic reason why the Constitution is established: to provide Justice for the Governed! Current political practice misplaces the People's Trust.

Purpose #2, Insure Domestic Tranquility--
The Fracking Industry is already producing emotional distress, physical turmoil, and visceral upheaval in the Pennsylvania homeland, and elsewhere.

Purpose #3, Promote the General Welfare--
Any commercial process which threatens our Natural Sanctity as does fracking, and challenges my Rights under the Pennsylvania Constitution or other law, is an affront to the U.S. People's Constitution.

Furthermore, there is no advertising campaign by the Fracking Industry sufficiently opaque to hide what we see before our eyes and looming on a near-future horizon. Fracking is poisoning our air and water resources, blighting our State and National Forests, degrading the People's priceless scenic landscapes in our time and for our posterity.

Therefore, Notice is hereby given: Failure by elected or appointed officials to defend the U.S. Constitution and Laws of the Land is a violation of oath of office, and reason enough for removal from office and to nullify your vote.

*Pennsylvanian's Rights as declared in Article 1 Section 27, Pennsylvania Constitution include: "...a right to clean air, pure water, and to the preservation of the natural, scenic, historic and esthetic values of the environment. Pennsylvania's public natural resources are the common property of all the People, including generations yet to come. As trustee of these resources, the Commonwealth shall conserve and maintain them for the benefit of all the People."

Why is this important?

The Delaware River Basin Commission postponed their vote which had been scheduled to take place last November 21, 2011. The current temporary ban (moratorium) on Fracking in the Delaware River Watershed could be lifted at any time, and with very short notice, by a vote of the DRBC. This would threaten the environment and endanger the water supply of millions of people in parts of 4 States.
The severity of the threat has now been broadened and increased by the recent enactment of PA Act 13.
